1. Introduction
Welcome to Yumsto!
These terms of service ("the Terms") govern the use of the website at www.yumsto.com and the
Yumsto mobile app (together "the Services"), operated by Yumsto s.r.o., company no. 09685065,
registered office: Příčná 1892/4, Nové Město, 110 00 Prague 1, registered in the Commercial
Register kept by the Regional Court in Ústí nad Labem under file no. C 46184 ("the Company", "we",
"our", "us").
Our Privacy Policy describes how we handle your data and, together with these Terms, forms your
agreement with us (together "the Agreements").
If you do not agree with the Agreements, or cannot comply with them, please do not use the
Services. Do write to us at support@yumsto.com though — we will try to find a solution. These
Terms apply to all visitors and users of the Services.
These Terms are also published in Czech. If the two versions differ, the Czech version prevails.
2. Communication and commercial messages
Operational messages about your order — confirmation, invoice, delivery status, complaint outcome
— are always sent to you. They are part of performing the contract and cannot be unsubscribed from
while we are handling your order.
We will only send you newsletters and offers if you sign up for them, or if you have bought from
us and have not declined offers of similar goods. You can unsubscribe at any time — using the link
in every email or by writing to support@yumsto.com. We do not treat merely using the Services
as consent to receive them.
3. Contests and promotions
Any contests, prize draws or other promotions (together "Promotions") available through the
Services may be governed by their own rules, separate from these Terms. If you take part in a
Promotion, please read its rules and our Privacy Policy. If the rules of a Promotion conflict with
these Terms, the rules of the Promotion apply.
4. Content
Our Services let you post, store, share and otherwise make available information, text, graphics,
videos, recipes or other material ("Content"). You are responsible for the Content you post —
including whether it is lawful and whether you hold the rights to it.
By posting Content you confirm that (i) it is yours or you have the right to use it and to grant
us the licence under these Terms, and (ii) that posting it does not infringe copyright, privacy
rights or any other rights of another person.
You keep the rights to your Content. By posting it you grant us a free licence to use it within
the Services, adapt it for display purposes, reproduce it and make it available to other users of
the Services. The licence lasts for as long as you leave the Content in the Services; once you
delete it, we stop displaying it.
We have the right, but not the obligation, to monitor and moderate user Content.
Content that we publish in the Services — recipes, text, photographs, design and software — is
ours or used with permission. Without our prior written consent you may not reproduce, modify,
transmit or otherwise use it for commercial purposes or for your own profit. Ordinary personal
use, sharing a link, and quotation in line with copyright law are not affected.
5. Online store and sale of goods (purchase contract)
5.1. Product and price information
All presentation of confectionery and other goods in the web interface (the Service) is
informative in nature and the seller is not obliged to conclude a purchase contract for those
goods. Section 1732(2) of the Czech Civil Code does not apply.
Please note that we are not VAT payers (we are only an identified person under
the VAT Act). Prices of goods are stated as final (they contain no output VAT) and include all
related charges except delivery costs. Delivery costs are shown in the "basket" before you submit
your order.
Where we show a discount on goods, that discount is calculated from the lowest price at which we
sold the goods in the 30 days before the discount was applied (in line with Section 12a of the
Czech Consumer Protection Act).
5.2. Orders and formation of the contract
You create an order by completing the form on the site. Before submitting it you can review and
change the details you entered. You submit the order by clicking the button labelled
"Order and pay" (or another wording expressing an obligation to pay). This makes
the order binding.
The purchase contract is concluded at the moment we deliver confirmation of receipt of the order
(acceptance) to your email.
5.3. Payment terms (Stripe)
You pay the price of the goods and delivery costs by card through the Stripe payment gateway.
Payment is due immediately when the order is submitted.
You do not enter sensitive payment card details with us but directly with the gateway operator. We
have no access to your full card numbers.
We will send you the invoice (a tax document from a non-VAT payer) electronically by email once
the price has been paid.
5.4. Shipping and delivery
We deliver throughout the Czech Republic and to Slovakia. We deliver goods via Zásilkovna
(Packeta) and PPL; you choose the shipping method in the basket. Delivery prices for Slovakia are
stated in Czech crowns.
We dispatch most orders within 24 hours of receiving payment. Delivery usually takes 1–2 working
days in the Czech Republic and 2 working days to Slovakia; these are indicative figures that
depend on the carrier.
- Passing of the risk of damage: the risk of damage to the goods passes to you when you take
delivery of them.
- Duty to inspect: when taking a parcel from the carrier you are obliged to check that the
packaging is intact. If the packaging is damaged, we recommend not accepting the parcel from the
carrier and having a damage report drawn up. Opening a food product after taking delivery can no
longer be claimed as damage caused in transit.
5.5. Withdrawal from the contract (food specifics)
As a consumer you have the right under Section 1829 of the Czech Civil Code to withdraw from the
contract within 14 days of taking delivery of the goods, without giving a reason.
Please note, however, that we sell food (confectionery). Under Section 1837 of
the Czech Civil Code you cannot withdraw from a contract:
a) for the supply of goods that are perishable (e.g. fresh confectionery), or goods that after
delivery have been irreversibly mixed with other goods [Section 1837(e)];
b) for the supply of goods in a sealed package which you removed from the package and which cannot
be returned for hygiene reasons (opened bags of sweets, unwrapped chocolate) [Section 1837(g)].
If the goods have not been removed from their hygienic packaging and are not perishable, you have
the right to return them within 14 days. We cover the cost of return shipping in that case.
You can withdraw by any unambiguous statement — an email to support@yumsto.com is enough, or
you can use the model form in article 5.6. We will confirm receipt of your withdrawal without
undue delay and send you a prepaid shipping label to download and print, with which you can hand
the parcel in at a pick-up point or give it to the carrier.
We will return the money received no later than 14 days from withdrawal, by the same means we
received it. We are not obliged to return it before you hand the goods over to us or show that you
have sent them to us.
5.6. Model withdrawal form
Complete and send this form only if you wish to withdraw from the contract. Using the form is not
mandatory.

5.7. Rights from defective performance (complaints)
The rights and obligations of the parties regarding rights from defective performance are governed
by the applicable generally binding regulations (in particular Sections 1914 to 1925, 2099 to 2117
and 2161 to 2174b of the Czech Civil Code and Act No. 634/1992 Coll., on consumer protection).
We are responsible for the goods being free of defects when you take delivery (having the agreed
characteristics, being fit for purpose and complying with legal regulations).
Given the nature of the goods (food), rights from a defect must be exercised by the best-before or
use-by date stated on the packaging.
A change in the characteristics of the goods arising from your incorrect storage after taking
delivery (e.g. chocolate melting in the heat) is not a defect.
Submit a complaint to support@yumsto.com. We will confirm receipt of your complaint and settle
it, including remedying the defect, no later than 30 days from the day it is made, unless we agree
a longer period together. We will inform you of the outcome.
6. Prohibited uses
You may use the Services only for lawful purposes and in accordance with these Terms. You agree
that you will not use the Services:
0.1. in any way that breaches applicable legal regulations;
0.2. for the purpose of harming minors in any way, including exposing them to inappropriate
content;
0.3. to transmit or arrange the sending of advertising or promotional material, including
unsolicited mail, chain letters, spam or any other similar solicitation;
0.4. to impersonate or attempt to impersonate the Company, its employee, another user or any other
person or entity;
0.5. in a way that infringes the rights of others, or that is unlawful, threatening, fraudulent or
harmful, or in connection with any such purpose or activity;
0.6. for conduct that restricts or prevents others from using the Services.
You further agree that you will not:
0.7. use the Services in a way that could disable, overburden, damage or impair them, or interfere
with anyone else's use of them;
0.8. use robots, spiders or other automated means to access the Services, including monitoring or
copying any material;
0.9. copy material from the Services by a manual process for any unauthorised purpose without our
prior written consent;
0.10. use any device, software or routine that interferes with the proper working of the
Services;
0.11. introduce viruses, trojan horses, worms, logic bombs or other technologically harmful
material;
0.12. attempt to gain unauthorised access to any part of the Services, to the server on which they
are stored or to any connected databases, or disrupt or damage them;
0.13. attack the Services by means of a denial-of-service attack or a distributed
denial-of-service attack;
0.14. take any action that may damage or falsify the Company's rating.
7. Accounts and age
You can create an account with us if you are at least 15 years old. You can also buy from us if
you are younger, but only to an extent appropriate to your age and maturity under Section 31 of
the Czech Civil Code; for larger purchases we reserve the right to ask for a legal guardian's
consent.
You warrant that the information you give us is accurate, complete and current. Inaccurate,
incomplete or outdated information may lead to your account being cancelled.
You are responsible for keeping your account and password confidential and for all activity that
takes place under your account. Tell us immediately about any breach of security or unauthorised
use of your account.
Without proper authorisation you may not use another person's username, or a name or trade mark to
which someone else holds rights. You may not use a username that is offensive, vulgar or
obscene.
We reserve the right to refuse service, delete an account or remove content where this is
necessary because of a breach of these Terms or of legal regulations. Purchase contracts already
concluded are not affected.
8. Intellectual property
The Services and their original content (excluding Content provided by users), features and
functionality are and will remain the exclusive property of Yumsto s.r.o. and its licensors. The
Services are protected by copyright and trade mark law. Our trade marks may not be used in
connection with any product or service without our prior written consent.
9. Reporting illegal content
We respect intellectual property rights and the other rights of third parties. If you come across
content in the Services that you consider illegal — including content that infringes copyright —
let us know at support@yumsto.com.
Please include in your report:
0.1. a sufficiently reasoned explanation of why you consider the content illegal;
0.2. the exact location of the content, usually the URL;
0.3. your name and email address (do not give them if the report concerns an offence against
children);
0.4. a statement that you are making the report in good faith and consider the information in it
accurate and complete.
We will confirm receipt of your report without undue delay, assess it and inform you of our
decision, including information about the available means of redress. We follow Article 16 of
Regulation (EU) 2022/2065 of the European Parliament and of the Council on digital services.
You may be liable for damage caused by a false report made in bad faith.
10. Bug reports and feedback
You can give us feedback about errors, suggestions for improvement, ideas and complaints
("Feedback") at support@yumsto.com or through third-party tools. You acknowledge and agree
that:
(i) Feedback does not contain confidential information of yours or of any third party;
(ii) the Company has no duty of confidentiality towards Feedback;
(iii) the Company may develop solutions similar to the Feedback independently of you;
(iv) you grant us a free, non-exclusive and unlimited-in-time right to use the Feedback to develop
and improve the Services. Your moral and copyright rights are not affected.
11. Links to other websites
Our Services may contain links to third-party websites or services that we neither operate nor
control.
We have no control over them and take no responsibility for their content, privacy policies or
practices. We recommend reading the terms and the privacy policy of every site you visit.
12. Liability
We do our best to keep the Services available and working properly, but we do not guarantee
uninterrupted availability. We may restrict or suspend the Services for operational reasons, for
example for maintenance or updates.
We are liable for damage under the Czech Civil Code.
We do not limit or exclude liability for harm caused intentionally or by gross
negligence, for harm to a person's natural rights, or any rights granted to you as a consumer by
mandatory provisions of law — in particular the rights from defective performance under article
5.7.
We are not liable for content published by users or for the content of third-party sites we link
to.
13. Out-of-court dispute resolution and supervision
If you are not happy with how your order or complaint was handled, write to us first at
support@yumsto.com — we resolve most things directly.
The body competent for the out-of-court resolution of consumer disputes arising from the purchase
contract is the Czech Trade Inspection Authority (Česká obchodní inspekce),
registered office Štěpánská 796/44, 110 00 Prague 1, company no. 000 20 869, website:
https://adr.coi.cz. You can file a proposal no later than 1 year from the day you first exercised
your right with us. The proceedings are free of charge for consumers.
Supervision of compliance with consumer protection regulations is exercised by the Czech Trade
Inspection Authority; supervision of food is exercised by the Czech Agriculture and Food
Inspection Authority (Státní zemědělská a potravinářská inspekce). Supervision of personal data
protection is exercised by the Office for Personal Data Protection (Úřad pro ochranu osobních
údajů).
14. Termination
You can cancel your account at any time by writing to support@yumsto.com.
We may suspend or cancel your account if you materially breach these Terms or legal regulations,
or where the law requires it. Where the circumstances allow, we will warn you in advance and give
you the opportunity to put things right. Termination does not affect purchase contracts already
concluded or your rights from defective performance.
15. Changes to these Terms
We may change these Terms from time to time. We will publish the new version on this page and
update the last-updated date at the top.
The version of the Terms in force at the moment you submit an order always applies to that order.
Changes therefore never apply retroactively to contracts concluded earlier.
16. Governing law and contact
The Agreements are governed by the law of the Czech Republic. If you are habitually resident in
another European Union state, this does not deprive you of the protection given to you by the
mandatory provisions of the law of your own state.
